Sweeping changes have been proposed to the civil justice system in Ontario by the Ontario Civil Rules Review Working Group. If implemented, these proposals would reflect a “once in a generation” reform to the Ontario Rules of Civil Procedure. This session will cover what you need to know about the proposed changes, which include:

  •         The elimination of oral discovery;
  •         The introduction of pre-litigation protocols, including the early exchange of information and documents;
  •         One point of entry to the litigation system, regardless of whether previously commenced as a claim or application; 
  •         More limited documentary disclosure based on documents the parties to rely upon and any adverse documents.

 

This session is intended to be an informative educational opportunity for law clerks who work in civil litigation.
