Personal Injury Legal Assistant/Clerk
Mirian Law Firm is currently seeking a managing Law Clerk / legal assistant looking to grow with our firm.
A successful candidate will have the following credentials:
- Strong familiarity of rules of civil procedure and Statutory Accident Benefits
- At-least 2 year of experience as a law clerk in a personal injury firm
- Self-starter
- Strong interpersonal skills
- Flexible
- Excellent organizational skills is a must
- Ability to multi-task in a fast paced environment
- works cooperatively within a team structure and fosters a sense of teamwork with the broader office support staff.
- strong attention to detail and the ability to identify the relevance of those details; and if you have the interpersonal skills to foster a positive sense of teamwork
- Ability to speak farsi is a plus
Duties
- Organize legal documents
- Open personal injury files
- Working with conveyancer, PClaw
- Produce billing
- Following up with undertakings, client reporting, and intakes
- Drafting and production of letters to insurance companies, doctors, OHIP, police etc.
- Administrative tasks---scanning, photocopying, answering phones, scheduling meetings, coordinating with clients and respective counsels etc.
- Draft pleadings, Affidavit of Documents, Settlement proposals, motion records, trial records, Statements of Issues, pre-trial memorandum, pre-arbitration memorandums;
- Review files and summarize documents, including medical reports, employment records etc. emphasizing themes set out in file theory;
- Identify files ready for settlement discussions or appropriate to prepare for settlement conferences;
- Prepare claims forms for accident benefits and submit them to the insurer, including meeting with client to obtain any information or documentation required;
- Monitor insurer responses to claims forms and take follow-up action as necessary;
Understand all major concepts relating to AB claim, mediation and arbitration proceedings;
- Identify issues that require the attention of the lawyer, and bring them to his or her attention, including;
- Rehabilitation and medical needs that may not be being met;
- Note in Time Matters and keep track of limitation dates arising from denials of benefits;
- Prepare Applications for Mediation and Arbitration;
- Schedule a variety of events and complete corresponding tasks;
- Examinations for discovery (send Notices of Examination and communication to client),
- Expert Witness appointments (advise client, prepare and send medical brief in a timely fashion),
- LAT case conferences, pre-arbitration hearings, motions, pre-trial hearings, meditations;
- Draft Affidavits of Documents, summarize discovery transcripts, monitors defendant productions;
- Understand all major concepts relating to tort proceedings;
- Draft mediation and pre-trial memos and prepare briefs;
- Monitor defense medicals;
- Assist with trial preparation including summons to witnesses and date coordination with experts;
- Assist in organizing files, sort and brat new filing, prepare file indexes;
- Request and review medical documentation;
- Prepare pleadings for tort claims and claims for Accident Benefits;
- Request documentation to advance a personal injury claim;
- Communicate with adjusters and lawyers to coordinate events and facilitate the production of documents;
- Other duties as assigned.
